1. Agreement to Terms
By accessing or using Eclipta ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.
These Terms constitute a legally binding agreement between you ("User" or "you") and Eclipta ("we," "us," or "our").

2. Description of Service
Eclipta is an Instagram content scheduling platform that enables users to:
- Connect Instagram Business or Creator accounts via the official Instagram Platform API
- Create and manage content templates with dynamic data
- Schedule posts, stories, reels, and carousels for future publication
- Integrate real-time data from external APIs (weather, exchange rates, etc.)
- Generate images using in-platform AI tools
Important: Eclipta is a scheduling tool, not an automated bot. Users retain full control over what content is posted and when it is published.
3. Eligibility
To use Eclipta, you must:
- Be at least 18 years old
- Have the legal capacity to enter into a binding agreement
- Possess a valid Instagram Business or Creator account
- Not be prohibited from using the Service under applicable laws
- Not have been previously banned from our Service
By using Eclipta, you represent and warrant that you meet all eligibility requirements.
4. Account Registration
4.1 Account Creation
To use Eclipta, you must create an account by providing:
- A valid email address
- Phone number (for OTP verification)
- A secure password
4.2 Account Security
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access
4.3 Account Accuracy
You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.
5. Instagram Account Connection
5.1 Authorization
By connecting your Instagram account to Eclipta, you:
- Authorize us to access your Instagram account via the official Instagram Platform API
- Grant us permission to publish content on your behalf at scheduled times
- Confirm that you have the authority to connect the respective Instagram account
5.2 Account Requirements
- Only Instagram Business or Creator accounts can be connected
- Personal Instagram accounts are not supported
- You may connect up to 2 Instagram accounts per Eclipta account (depending on your plan)
5.3 Disconnection
You may disconnect your Instagram account at any time via the dashboard. Upon disconnection:
- All scheduled posts will be cancelled
- Your access token will be deleted
- All Instagram-related data will be removed
6. Acceptable Use Policy
6.1 Permitted Use
You may use Eclipta to:
- Schedule legitimate content to your own Instagram accounts
- Create templates for your business or personal brand
- Integrate publicly available data from external APIs
- Manage multiple Instagram accounts you own or are authorized to manage
6.2 Prohibited Use
You agree NOT to use Eclipta for:
Content Violations:
- Posting content that violates Instagram Community Guidelines
- Posting illegal, harmful, threatening, abusive, or harassing content
- Posting content that infringes on intellectual property rights
- Posting spam, misleading, or deceptive content
- Posting adult, violent, or graphic content
- Posting content that promotes illegal activities
Platform Abuse:
- Circumventing Instagram rate limits or restrictions
- Creating fake engagement (fake likes, followers, comments)
- Automating actions beyond content scheduling (auto-follow, auto-like)
- Scraping or harvesting data from Instagram
- Interfering with the Instagram platform or other users
Account Violations:
- Connecting accounts you do not own or are not authorized to manage
- Sharing your Eclipta account credentials with others
- Creating multiple accounts to evade limits
- Impersonating others or misrepresenting your identity
- Buying, selling, or transferring any aspect of your account (including usernames) or soliciting, collecting, or using login credentials of other users
Technical Violations:
- Attempting to reverse engineer or hack our Service
- Introducing malware, viruses, or malicious code
- Overloading our systems with excessive requests
- Accessing our Service via unauthorized means
6.3 Consequences of Violation
Violations may result in:
- Warning and removal of content
- Temporary suspension of your account
- Permanent termination of your account
- Reporting to Instagram/Meta
- Legal action if necessary
7. Content Ownership and Responsibility
7.1 Your Content
You retain ownership of all content you create and schedule via Eclipta. By using our Service, you grant us a limited license to:
- Store your content on our servers
- Process your content for scheduling purposes
- Transmit your content to Instagram for publication
7.2 Content Responsibility
You are solely responsible for:
- All content you schedule and publish
- Ensuring your content complies with applicable laws
- Ensuring your content complies with Instagram policies
- Obtaining necessary rights and permissions for your content
7.3 Content Moderation
We reserve the right to:
- Review content for policy compliance
- Remove content that violates our Terms
- Suspend accounts that repeatedly violate policies
8. Intellectual Property
8.1 Our IP
Eclipta and its original content, features, and functionality are owned by us and are protected by copyright, trademark, and other intellectual property laws.
8.2 Limited License
We grant you a limited, non-exclusive, non-transferable license to use our Service for its intended purpose, subject to these Terms.
8.3 Restrictions
You may not:
- Copy, modify, or distribute our Service
- Use our trademarks without permission
- Create derivative works based on our Service
- Sublicense or transfer your rights to others
9. Third-Party Services
9.1 Instagram Platform
Our Service integrates with the Instagram Platform API. Your use of Instagram is subject to:
- Instagram Terms of Use
- Instagram Community Guidelines
- Meta Platform Terms
9.2 External APIs
If you use external API integrations (weather, exchange rates, etc.), you are responsible for:
- Complying with the terms of use of such services
- Providing valid API keys
- Ensuring data usage complies with applicable laws
9.3 AI Image Generation
If you use AI image generation features:
- You are responsible for the generated content
- Generated images must comply with our content policies
- You must not generate illegal or harmful content
10. Payment Terms
10.1 Subscription Plans
Eclipta may offer various subscription plans with different features and limits. Plan details and pricing are available on our website.
10.2 Billing
- Subscriptions are billed in advance on a monthly or annual basis
- Payment is due at the beginning of each billing cycle
- All fees are non-refundable unless otherwise stated
10.3 Price Changes
We reserve the right to change our pricing. We will provide at least 30 days' notice before any price increase takes effect.
10.4 Cancellation
You may cancel your subscription at any time. Upon cancellation:
- You will retain access until the end of your current billing period
- No refunds will be issued for unused time
- Your scheduled posts will continue until the end of your subscription
11. Service Availability
11.1 Uptime
We strive to maintain high availability but do not guarantee uninterrupted service. The Service may be temporarily unavailable due to:
- Scheduled maintenance
- Emergency repairs
- Factors beyond our control
11.2 Modifications
We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice.
11.3 Instagram API Changes
Our Service relies on the Instagram Platform API. Changes to the Instagram API may affect the functionality of our Service. We are not responsible for changes made by Instagram/Meta.
12. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- IMPLIED WARRANTIES OF MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- ACCURACY OR COMPLETENESS OF CONTENT
WE DO NOT WARRANT THAT:
- The Service will be uninterrupted or error-free
- Defects will be corrected
- The Service is free of viruses or harmful components
- The results of using the Service will meet your requirements
13. Limitation of Liability
13.1 Exclusion of Damages
TO THE EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or business opportunities
- Damages arising from the use or inability to use the Service
- Damages arising from unauthorized access to your account
- Damages arising from Instagram account restrictions or bans
13.2 Liability Cap
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR IDR 1,500,000, WHICHEVER IS GREATER.
13.3 Basis of Bargain
THE LIMITATIONS IN THIS SECTION REFLECT THE ALLOCATION OF RISK BETWEEN THE PARTIES AND ARE A FUNDAMENTAL BASIS OF THE BARGAIN BETWEEN US.
14. Indemnification
You agree to indemnify, defend, and hold harmless Eclipta and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Content you post via the Service
- Your violation of Instagram policies
15. Termination
15.1 Termination by You
You may terminate your account at any time by:
- Using the account deletion feature in your dashboard
- Contacting us at support@eclipta.my.id
15.2 Termination by Us
We may terminate or suspend your account immediately, without prior notice, if:
- You violate these Terms
- You violate Instagram policies
- We are required by law to do so
- We discontinue the Service
15.3 Effect of Termination
Upon termination:
- Your right to use the Service will immediately cease
- All scheduled posts will be cancelled
- Your data will be deleted in accordance with our Privacy Policy
- Provisions that should survive termination shall remain in effect
16. Dispute Resolution
16.1 Informal Resolution
Before filing a formal dispute, you agree to contact us at support@eclipta.my.id to attempt to resolve the dispute informally.
16.2 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Indonesia.
16.3 Jurisdiction
Any dispute arising from these Terms shall be resolved in the courts located in Jakarta, Indonesia.
16.4 Individual Resolution
You agree to resolve disputes individually and waive the right to participate in a class action lawsuit.
17. General Terms
17.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Eclipta regarding the Service.
17.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
17.3 Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
17.4 Assignment
You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.
17.5 Notifications
We may provide notifications to you via:
- Email to your registered email address
- Posting on our website
- In-app notifications
17.6 Force Majeure
We are not liable for any failure to perform due to causes beyond our reasonable control, including natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
18. Meta Platform Compliance
By using Eclipta, you acknowledge and agree that:
- Eclipta uses the official Instagram Platform API
- Your use of Instagram via Eclipta is subject to Meta Platform Terms
- We comply with the Instagram Platform Policy
- We do not facilitate spam, automated abuse, or policy violations
- We cooperate with Meta's compliance and enforcement efforts
- Instagram/Meta may revoke API access at any time
19. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by:
- Posting the updated Terms on our website
- Updating the "Last Updated" date
- Sending an email notification
Continued use of the Service after changes constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service.
